The day after the long conference, the Supremes issued the first order list of the term. The Supremes granted cert in 17 cases–none of them from the military. The order list included denial of cert in only two cases — both of which were Texas capital cases. The three military cert petitions docketed for yesterday’s conference will almost certainly be on the upcoming, and much longer, order list featuring denied summer cert petitions.

    CAAFloggers who monitor the Supreme Court’s docket might want to know that two cert petitions involving DOPMA’s promotion-delay provisions are pending: Lewis v. United States and Barnes v. United States. The Federal Circuit denied relief in both based on its decision in Dysart v. United States. All three cases involve naval officers.
