This week at the CCAs: ACCA will hear oral argument tomorrow in United States v. Thurston, No. ARMY 20090871. The issue being argued is “WHETHER THE POST-TRIAL TIMELINE IN THE STAFF JUDGE ADVOCATE ADDENDUM CONSTITUTED NEW MATTER PER RULE FOR COURTS-MARTIAL 1106(f)(7) AND, IF SO, WHETHER THE NEW MATTER CONSTITUTED PREJUDICE TO APPELLANT.”
