The Louisville Courier-Journal reports here that Steven Green has filed an appeal with the Sixth Circuit challenging his MEJA conviction arising from the rape of a 14-year-old girl in Iraq and the murder of the girl and three of her family members.  The report indicates that Green, who had already been discharged from the Army when the crimes came to light, is challenging the validity of his discharge and argues that he should have been court-martialed instead of being prosecuted in federal court.  I’ll try to get a copy of the appeal and post it.

    Who hopes he wins his appeal, and the Courts say he SHOULD go to military court-martial?

    so what he thinks a military panel will acquit him or give him a better sentence? Good luck with that although I guess he thinks it can’t get worse.

    Anon at 22:22: Yes, he absolutely thinks a military panel would give him a better sentence. Green is serving life without parole. One of the four soldiers that was court martialed in the same case is already out. The other three are eligible for parole after seven years.

    Where any of the other Soldiers as culpable as him? Because if he is charged with premed, unless he gets a deal, which I suppose is possible, the only difference will be life with parole instead of without. Sure that’s an improvement but unlikely to happen.

    Judging by the news articles, at least two of the other soldiers were as culpable. None though plead guilty to premed, and none technically are serving life sentences. Three of the four got 90 to 110 years, the other guy got five years and is already out.

    Note also that Green was tried capitally with the prosecution not offering a plea-bargain before the eve of jury selection. He still went to trial but the jury did not opt for the death penalty.
