Two more potential members were nixed by Judge Parrish today, see Fayetteville Observer reports here and here.  Three more members were interviewed today.  Judge Parrish adjourned for lunch before deciding the defense’s request to strike all three.   I found interesting that one potential member, presumably one of the ones that was struck, had been involved in assembling members for the venire, see FayObs report here.  How does that happen?

The same way a CA puts a husband AND wife who oppose (or favor for that matter) the death penalty on a capital case. (See Martinez case.)

  2. Omar says:

It’s a Brigade Commander that forwarded panel member nominations to the CA. Omar.

Thanks for the info. Informative, but not really persuasive of how it happened. Call me crazy, but in a case that has been tried capitally twice (resulting in one reversal on appeal for gov’t error and one acquittal), where if it goes awry this time after jeopardy has attached means the end of every possible road to prosecution, I’d probably make sure I dot my “i”s, my “j”s, and, oh yeah, make sure my members were conflict free. Again, feel free to call me crazy.

Ha! Not as crazy like me! No persuasion needed, it is fact. Omar doesn’t talk out of school.
