Thanks for the info. Informative, but not really persuasive of how it happened. Call me crazy, but in a case that has been tried capitally twice (resulting in one reversal on appeal for gov’t error and one acquittal), where if it goes awry this time after jeopardy has attached means the end of every possible road to prosecution, I’d probably make sure I dot my “i”s, my “j”s, and, oh yeah, make sure my members were conflict free. Again, feel free to call me crazy.

The same way a CA puts a husband AND wife who oppose (or favor for that matter) the death penalty on a capital case. (See Martinez case.)
