As reported by the LA Times here, LtCol David Jones, the military judge in United States v. Wuterich, ruled today that the defense had presented sufficient evidence to shift the burden to the government to show beyond a reasonable doubt that the case wasn’t affected by unlawful command influence.

The LA Times reports that Judge “Jones set a hearing for Wednesday to hear any evidence prosecutors want to present. Maj. Nicholas Gannon, one of the prosecutors, said he was ‘99.9% sure’ that he has no further evidence.”  Judge Jones reportedly indicated he would rule by Friday.
