Earlier today, we noted that the cert petition in Pendergrass v. Indiana, No. 09-866, has been distributed for the Supremes’ 10 June conference.  Now a friend o’ CAAFlog has provided us with a copy of Pendergrass’s reply brief, filed by the legal dream team of  Jeffrey Fisher, Pamela Karlan, Tom Goldstein, Amy Howe, Kevin Russell, and Jeffrey Kimmell.  Page 3 of the reply cites CAAF’s Blazier decision.  We’ve posted the reply here.
