On Friday, the Supremes docketed a cert petition in Contreras v.  United States, No. 10-413.  CAAF’s decision in the case is published at 69 M.J. 120.  I’ll try to get a copy of the cert petition and post it tomorrow.

    I thought the way CAAF resolved this case was sensible, though novel and not immune from reasonable criticism. That said, I have my doubts that housebreaking comes up in the court-martial context often enough, particyularly where the underlying offense isn’t clearly a non-military offense, for this petition to constitute anything other than a plea for error correction. That’s not to say the petition shouldn’t be filed, I just have my doubts that it has the sex appeal to be granted.
