NIMJ reported today that the Lakin court-martial has been pushed back to 4 November.  According to this report from WUSA, the extra time was granted to “give the defense more time to ask the court of appeals for help.”  Considering both the defense’s delay of approximately 25 days before filing the petition for extraordinary relief and the implausibility of obtaining extraordinary relief, it’s quite surprising that Judge Lind would delay the trial on that basis.  [We’re trying to get a copy of the petition for extraordinary relief, but so far have received no reply to our request to ACCA for a copy.]

At the same link, you can see a clip of LTC Lakin’s civilian attorney, Paul Rolf Jensen, saying:  “And President Richard Nixon said he wasn’t a crook, and President Clinton said he didn’t have sex with that woman,.  The point is, we are in a court of law, let him come in and be subject to cross examination with the original documentation. What do they have to hide?”

    I have several comments. First, it would appear that Judge Lind is bending over backwards to appear to be fair to the Lakin side by delaying the court martial. She, of course, can’t ignore the law and rule in favor of their silly motions.

    Jensen was quoted as saying that Judge Lind has taken away their defense. Actually, this is not true. Judge Lind has taken away the defense they wanted to pursue because is was not legally valid.

    Another issue that needs to be addressed is this idea that LTC Lakin is only acting upon his oath to defend the Constitution of the Untied States. GEN Vallely and GEN McKiernon have also echoed this argument. Well, their copy of the Constitution must be a very abbreviated one and only include Article II, Section 1, Clause 5 (or 4 depending on how you count). It seems to omit all other portions about the selection and removal of the President such as the rest of Article II Section 1, and especially Section 4. It also contains a clause that says every soldier is to be the arbiter of what the Constitution actually says. I can’t seem to find that clause in my copy.

    This case is simple. LTC Lakin questioned his orders. The Army verified those orders were valid. He chose to to disobey them. Now his team is crying foul.

    Actually, it’s pretty sad when you think about it, but hey at least you’re not a birther, so you have that going for you, which is good!
    Watching the birthers is like going to the state fair–you see people that make you feel much better about yourself.

    If there is anything notable about the Lakin case, I would say that it’s really how unsurprising is each development. Pretty much every one of the judge’s rulings so far was accurately predicted months ago on this very blog – and were forecast by persons well-versed in military law and with everyone in (more or less) complete agreement with each other.

    Yet, each time Judge Lind makes a ruling, Jensen reacts with apparent surprise, shock even, at her utterly predictable decision. Therefore, I can only conclude that Jensen does not read this blog – nor does he have any apparent understanding of military jurisprudence.
