NIMJ reported today that the Lakin court-martial has been pushed back to 4 November.  According to this report from WUSA, the extra time was granted to “give the defense more time to ask the court of appeals for help.”  Considering both the defense’s delay of approximately 25 days before filing the petition for extraordinary relief and the implausibility of obtaining extraordinary relief, it’s quite surprising that Judge Lind would delay the trial on that basis.  [We’re trying to get a copy of the petition for extraordinary relief, but so far have received no reply to our request to ACCA for a copy.]

At the same link, you can see a clip of LTC Lakin’s civilian attorney, Paul Rolf Jensen, saying:  “And President Richard Nixon said he wasn’t a crook, and President Clinton said he didn’t have sex with that woman,.  The point is, we are in a court of law, let him come in and be subject to cross examination with the original documentation. What do they have to hide?”

h/t to Reality Check in a comment on Phil Cave’s blog for the link to the WUSA report.

Jensen says: “What do they have to hide?”

The irony meter is getting closer to exploding.

    You are welcome, Mr. Sullivan.

I have several comments. First, it would appear that Judge Lind is bending over backwards to appear to be fair to the Lakin side by delaying the court martial. She, of course, can’t ignore the law and rule in favor of their silly motions.

Jensen was quoted as saying that Judge Lind has taken away their defense. Actually, this is not true. Judge Lind has taken away the defense they wanted to pursue because is was not legally valid.

Another issue that needs to be addressed is this idea that LTC Lakin is only acting upon his oath to defend the Constitution of the Untied States. GEN Vallely and GEN McKiernon have also echoed this argument. Well, their copy of the Constitution must be a very abbreviated one and only include Article II, Section 1, Clause 5 (or 4 depending on how you count). It seems to omit all other portions about the selection and removal of the President such as the rest of Article II Section 1, and especially Section 4. It also contains a clause that says every soldier is to be the arbiter of what the Constitution actually says. I can’t seem to find that clause in my copy.

This case is simple. LTC Lakin questioned his orders. The Army verified those orders were valid. He chose to to disobey them. Now his team is crying foul.

Correction: I meant to type GEN McInerney

A recent poll showed that 1 in 5 Americans believe Obama is a cactus.

When asked why they agreed with the statement “President Obama is a large succulent plant composed of specialized cells designed for water retention in arid climates,” many responded that they “just know,” claiming the president only acts like a human being for political purposes and is truly a cactus at heart.

Anything useful to submit to the discussion?
    Yeah. Thought not.
Listen, I gotta ask–just how detached from reality do you have to be to come to a blog of maintained and serving military and DoD people and start that nonsense? I mean really, you can’t read the info on the contributors on the right side or at least a couple of other postings here and find out what it is that these guys talk about all day long?

I personally think the president is a CBS but freely admit he could be an ABC.

Question though Vergilicious, just how queer is a $3 dollar bill? I mean are we talking just experimented in college level of queerness or are we talking an instructor at Drag U queerosity? Would a $4 bill be even queerer or equally queer to a $3 bill?

    Yours in twisted sickness,

    Well, it could be worse.

Actually, it’s pretty sad when you think about it, but hey at least you’re not a birther, so you have that going for you, which is good!
Watching the birthers is like going to the state fair–you see people that make you feel much better about yourself.

If there is anything notable about the Lakin case, I would say that it’s really how unsurprising is each development. Pretty much every one of the judge’s rulings so far was accurately predicted months ago on this very blog – and were forecast by persons well-versed in military law and with everyone in (more or less) complete agreement with each other.

Yet, each time Judge Lind makes a ruling, Jensen reacts with apparent surprise, shock even, at her utterly predictable decision. Therefore, I can only conclude that Jensen does not read this blog – nor does he have any apparent understanding of military jurisprudence.

  13. Trevor says:

The problem for our Birfoon bretheren is they predominately inhabit the tightly controlled, hot house worlds such as the Pest and Fail, WND, JAGHunter etc etc.

In these monoculture ecosystems, any and all dissenting opinions are ruthlessly excluded leading to an almost monomaniacal “purity of thought”. In these clades, Lakin is a Konstitutional Hero and Da Ebil Obama is personally keeping him down as part of his dastardly Mooslem, Commie, Nazi, Socialist, Sharia plan.

Once they venture outside of their highly restricted ecological niche, they inevitably expect everyone else to cleave to their worldview….if not, THOU ART TRAITOR.

So, as standard meme, Birfer loons all ostensibly laud the military to the heavens (and want to get their military takeover of the government on) EXCEPT when they disgree with Birfers.

Perfect example is in a variety of the loons web sites, Col Roberts, Lakins CO, a Medal of Honor recipient is labelled a coward lacking all semblance of moral fibre.

It’s a pathology and will never damp down as long a dusky hued individual with a funny name inhabits the White House.

If you want an insight into the sick thinking of these folks check out this brutal attack on Judge Lind by birther Citizen Wells:

“…. Well Denise let me put it this way, I can never respect a Pentagon Prostitute, so I am looking at your shoulders to see your rank. What I see are not eagles, they are vultures. It is not rank I see, just cheap costume jewelry.

You are a disgrace to the uniform you wear, you are a disgrace to men and women whose sacrifice has allowed you to play soldier and you are a disgrace to the flag that has covered the men and women who did not run from danger but ran to it.

Let me put it this way to you, the political question you do not want to embarrass the pResident with, is a constitutional question and you “darling”swore an oath to protect that old dusty parchment. The military has no authority to remove the pResident, this is true, but it does not only have the authority to ensure the Constitution is protected, but the sworn duty to. Protect the Constitution and let the chips fall where they fall. ”

I am sure da verg agrees.
