Today Carolyn Martin filed a declaration updating the relevant facts in her suit against NCIS, the MCRD San Diego SJA, and others, which we previously discussed here and here.  The complete declaration is here.  Here’s what seems to be the most important part:

2. I continue to work on the case at MCRD San Diego involving charges of conspiracy, effecting unlawful enlistment, appointment, or separation, and failure to obey order or regulation. That case is currently set for a motions hearing on October 7 and trial from November 16-18, 2010.

3. On September 30, 2010, a prosecutor who works for the Office of the Staff Judge Advocate at MCRD San Diego confirmed in writing that I am barred from Building 12 at MCRD San Diego, which includes the military criminal defense offices, the legal assistance office, and the courtroom.
