CAAF granted review today on an SJA disqualification issue, but ordered that no briefs be filed.  Here’s the granted issue:

WHETHER APPELLANT IS ENTITLED TO A NEW REVIEW AND ACTION BECAUSE THE STAFF JUDGE ADVOCATE’S RECOMMENDATION WAS PREPARED BY A LEGAL OFFICER WHO WAS DISQUALIFIED BECAUSE HE WAS NOT NEUTRAL.

United States v. Ramos, __ M.J. __, No. 11-0021/AR (C.A.A.F. Nov. 23, 2010).  ACCA’s unpublished decision in the case is available hereUnited States v. Ramos, No. ARMY 20090099 (A. Ct. Crim. App. July 19, 2010).

The case appears to be a trailer of United States v. Stefan, 69 M.J. 171 (C.A.A.F. 2010) (order granting review).  CAAF heard oral argument in Stefan on 9 November.
