An alert reader called our attention to the fact that military death row inmate Timothy Hennis’s counsel filed his reply brief in Hennis’s appeal of denial of habeas relief.  The case is pending before the 4th Circuit.  We’ve posted the reply brief here.

    The poor writing ability of the author of this document significantly detracts from its persuasiveness. Unfortunate, to be sure. . . . The outcome should not be dependent upon whether the lawyer is articulate, but that is life.

    I must agree. When the brief repeatedly refers to a lack of jurisdiction under the “USMJ” it is hard to lend much weight to the rest of the argument.

    One also has to wonder why this wasn’t coordinated with Hennis’s military counsel who surely would have caught that elementary mistake.
