Phil “My Liege” Cave notes on his blog that a CAAF petition was filed in United States v. Behenna, No. 12-0030/AR, on Monday.  Yesterday, CAAF granted a motion for an extension of time to file the supplement, which is due on 11 October.

    Does it signal anything that the court granted the appellant’s motion for extension, or is that mainly a pro forma thing?
    How long until CAAF either grants the petition to hear the appeal or refuses? Won’t that be for the next term, which starts next September, 2012, or would it be some time this term?

    SG, the extension grant doesn’t really signal anything. CAAF doesn’t have strict deadlines for granting or denying review, but they haven’t let things sit around for long in recent terms. Even with a new judge coming on board soon, I think we’ll see a grant/denial in the next couple of months. If granted, the case would get briefed, argued, and decided this term.
