Mr. Partington’s counsel today filed this motion to extend the TRO past 1530 today.  Here’s Judge Scullin’s ruling:

TEXT ORDER Denying Motion by Plaintiff for an extension of the TRO. The Court finds that good cause has not been shown to grant an extension. Therefore, the defendant’s Motion for reconsideration is Denied as Moot. The TRO ceased to be in effect as of 3:30pm, December 2, 2011.

Mr. Partington’s counsel also asked that the preliminary injunction hearing currently scheduled for 29 December be moved to some time in January.  The motion noted that DOJ opposed that request.  Judge Scullin denied that request as well, ruling:  “The oral argument on the motion for a preliminary injunction remains scheduled for December 29, 2011 at 10:00am.”

    That was a pretty lame request imho.  If you’re going to claim harm, at least specify the specific harm you’re talking about.

    Agreed.  I’ve tried to, at least obliquely, defend Partington (or, more accurately, criticize the government).  But if the guy doesn’t adequately defend himself…what can you do?
