This week at CAAF: CAAF has completed its oral argument schedule for the term.

This week at the ACCA: The Army CCA will hear oral argument in United States v. DeMarsh, No. 20110088., on Wednesday, May 30:

Case Summary:  Appellant was convicted at a general court-martial of willfully disobeying a superior commissioned officer and abusive sexual contact. Appellant was sentenced to a bad-conduct discharge, confinement for eighteen months, and reduction to the grade of E-1.

Granted Issues:
(I) [Whether] the military judge abused his discretion in admitting prosecution exhibits 5 and 6 into evidence because the government failed to corroborate the essential facts contained in the CID statement and facebook message, the sole evidence that any sexual contact even occurred, IAW Military Rule of Evidence 304(g).
(II). Whether appellant was denied his Sixth Amendment right to effective assistance of counsel where defense counsel failed to conduct a proper investigation and present vital evidence to the military judge.
