This week at SCOTUS: The cert petition in Lusk was denied last week. The writ petition in Partington was distributed for conference on Nov. 26. I’m not aware of any military justice developments at the Supreme Court, where I’m tracking only the petition for a writ of mandamus in the Partington case:

This week at the ACCA: The Army CCA will hear oral argument in one case this week, on is on Thursday, November 14, 2013, at 10 a.m.:

Issues:
I. Whether the military judge violated the accused’s right to accurate and complete instructions when Appellant was charged with committing an intentional act and the military judge instructed the panel that “the accused’s conduct must have amounted to more than simple negligence[?]”
II. Whether the military judge violated the accused’s personal right to make his own defense when the military judge instructed the panel on an affirmative defense over appellant’s objection?

This week at the AFCCA: The Air Force CCA will hear oral argument in two cases this week: United States v. Gurney on Wednesday, November 13, 2013, at 10 a.m., and United States v. Morita on Thursday, November 14, 2013, at 10 a.m. No further information is available on the CCA’s website.

This week at the CGCCA: The Coast Guard Trial Docket shows no scheduled oral arguments at the Coast Guard CCA.

This week at the NMCCA: The next scheduled oral argument at the Navy-Marine Corps CCA is on November 26, 2013.
