    While the safe money is probably on a government victory, it sure seemed to me like the judges were a lot more skeptical of the government’s arguments than the defenses, and the government seemed a lot more out on a limb with some of their assertions. When it started, Stucky seemed very pro-government, almost offended at the defense appellate’s arguments, but somewhat surprisingly to me, he asked some good questions of the government as well. Baker seemed the most defense-friendly, but obviously how folks seem during argument may have nothing to do with how they ultimately vote.
    It will be interesting to see what happens.
