    Zach: It’s a shame CAAF did not at least give you a hearing on this issue.  Your argument makes sense.  More importantly, the Court’s decision does seem to trade one Equal Protection problem for another.  If no other class of accused can be convicted of assault under the Court’s theory, a SCOTUS petition might be worth pursuing.
