This week at the ACCA: The Army CCA will hear oarl argument in one case this week, on Friday, September 18, 2015:

United States v. Bailey, No. 20130383

Issues:
I. Whether the military judge committed plain error in instructing the panel that appellant could be convicted of manslaughter and negligent homicide if appellant’s actions were merely a contributing cause to the accident that took a pedestrian’s life.
II. Whether the military judge erred in allowing a government witness to testify that appellant’s blood contained synthetic cannabinoid compounds because that witness’s testimony was based solely upon the testimonial hearsay declarations of lab technicians who were not subjected to confrontation.
