Neither argument went well for the Government.  “Congress admittedly totally messed up Article 120.”  Love it when Judge Stuckey calls it like it is.

I read the facts of Pease.  BS is drunk, has sex with Pease at a point where she is on top, then fellates him while he is lying on his back, and testifies at trial that she enjoyed it at the time, but afterwards, she did not.  And, the Government does not agree that the charge should be dismissed at a 917 motion that I would assume the defense, or the MJ sua sponte, brought?  And did the Government argue that the Accused should be convicted of an Article 120 offense based on those facts which was proof beyond a reasonable doubt?  And the panel convicted Pease??????  And, she only reports this after finding out that Pease had intercourse with another PO aboard the ship a few weeks before who convinces BS that she is a victim and she should report, then the PO reports as well?
