Phil Cave.  I am still suspicious of this.  It came too close on the heels of Baker’s departure and if anyone is looking at the Military Justice system and not saying that it needs some adult oversight they are delusional.  If the CAAF is trying to repaint itself as “the Supreme Court for military justice” its going to take more than an typeface change.

Well, my personnel thought is that the CCA’s should be removed, the CAAF expanded to nine and be allowed to sit in panels of three, followed by a petition to the Supreme’s in the same manner as any federal appellant who is in the 4th, 2nd., 9th. or any other federal circuit court of appeals.  But that’s just me.

  3. Vulture says:

I could be down with that.  Everyone gets and appeal regardless of sentence.  The OTJAGs are taken from the process.  Transfer of those that would be CCA judges to the Defense Appellate Divisions.

    P. Cave.  Let me back off from that last prospect.  How about a civilian run DAD?
