  1. (Former)ArmyTC says:

RCM 916(b)(4) and 916(j)(3) are both deleted…so Mistake of Fact as to consent is no longer a recognized defense under the manual? See, Article 120(f).

  2. Zachary D Spilman says:

916(j)(1) is the basic rule. (j)(3) was a special rule for the 2006 version of 120.

  3. Scott says:

The expansion of 134 animal abuse beyond “public” animals is interesting.  In the field general 134 specs have been in use for a while, but it’s nice to have an enumerated offense.

  4. WYSISYG says:

Appears to still be a draft.

  5. Jason Pfeil says:

The official EO with the appendix has been published in the FR now.  The PDF URL is https://www.gpo.gov/fdsys/pkg/FR-2016-09-22/pdf/2016-22962.pdf.  Thanks!

  6. Jason Pfeil says:

Weird.  The system appended an inappropriate   after the URL.  Here’s the URL without that.  https://www.gpo.gov/fdsys/pkg/FR-2016-09-22/pdf/2016-22962.pdf.

  7. Callie says:

I’m confused about why RCM 916(j)(3) was created originally.  It doesn’t seem to have any language that contradicts RCM 916(j)(1).
