This week at SCOTUS: The Government received an extension of time to file a response to the cert. petition in Ortiz. I’m not aware of any other military justice developments at the Supreme Court, where I’m tracking five cases:

This week at CAAF: CAAF has completed its oral argument calendar for the term. A detailed list of this term’s cases is available on our October 2016 Term Page.

This week at the ACCA: The next scheduled oral argument at the Army CCA is on August 8, 2017.

This week at the AFCCA: The Air Force CCA’s website shows no scheduled oral arguments.

This week at the CGCCA: I’m still unable to access the Coast Guard CCA’s oral argument schedule.

This week at the NMCCA: The next scheduled oral argument at the Navy-Marine Corps CCA is on July 20, 2017.

Perhaps Commisso will be a focus of argument in Lazcano?

  2. Michael Korte says:

FYSA Lazcano Oral Argument was on 5 June; I was on leave but I heard it was interesting.  Nothing for the entire month of July that I’m tracking at ACCA, of course that could change rapidly.

  3. Zachary D Spilman says:

Thank you Michael Korte. I have corrected the post.

Lezcano came out on the 5th.  Interestingly, this was included at footnote 9:
“However, our superior court has now twice stated panel members have a continuing duty of candor to tell the court-martial upon discovering they answered prior
questions mistakenly or dishonestly. We would suggest amending the standard trial script in the Benchbook to inform them of this duty at the completion of voir dire.”
That’s what I said in the Commisso post @ 1:37 p.m. with Zack quickly piggybacking off my comment thereby confirming my brilliance.  Glad to see we made it into a footnote.

    Make that July 3, 2017……
